If your fixed term is 3 years or less, the fee for leaving early is set by law — not by your landlord, and not by what the agent tells you. s 107(4)

For fixed terms of 3 years or less. s 107(4)

  • Less than 25% of the term expired4 weeks rent
  • 25% to under 50% expired3 weeks rent
  • 50% to under 75% expired2 weeks rent
  • 75% or more expired1 week's rent

Some situations let you leave with no break fee at all — for example if you need to escape domestic violence, or the landlord has breached the agreement. Ask the chat, or call Tenants' Union NSW.
